1. Conditions for foreigners to rent a house

You as a tenant for a foreigner, and a tenant of a house or apartment needs to meet the following conditions under Article 119 of the Housing Law 2014:


The lessor must be the owner of the house or the person permitted by the owner to authorize the house transaction in accordance with this Law and the civil law. If the lessor is an individual, there must be full capacity for civil acts to carry out transactions on houses in accordance with civil law; if it is an organization, there must be legal status, except for the organization of giving to gratitude houses and houses of love.

The house lessee is a foreign individual, must have full civil act capacity to conduct house transactions in accordance with the provisions of Vietnamese law, must be subject to ownership of houses in Vietnam according to regulations. This Law is not required to have a temporary registration or permanent registration at the place where the house is traded.

If you are a foreign individual eligible to own a house in Vietnam, you need to comply with the provisions of Article 159 of the Housing Law 2014:


Foreign individuals invest in construction of houses according to projects in Vietnam according to the provisions of this Law and relevant laws;

Foreign individuals are allowed to enter Vietnam.

2. Conditions on housing for foreign individuals and organizations to hire

The head of the household has a legal certificate of house ownership.

There are no disputes over ownership and use rights.

Housing and apartment areas are separate, not combined with other houses.

Ensuring safety for tenants: solid house structure, good quality construction materials.

To ensure the supply of electricity, water, environmental sanitation and other essential conditions;

3. Approach the tenant properly

In order for the agreement between you and the tenant to become faster and more efficient, you should have a representative from a brokerage company for foreigners renting a house.


The representative will arrange a rental home tour, in conjunction with the meeting between you and the tenant. This is to exchange some initial details about the housing, the conditions of the lessee and the lessor.


4. Note on the rental contract

A lease for foreigners needs to have the following terms:


Name and address of the parties;

Describe characteristics of houses;

Rental price and payment method;

House delivery time;

Limit time for hiring;

Rights and obligations of the parties;

Commitment of the parties;

Other agreements; date, month, year of signing the contract;

Signature of the parties (if it is an organization, it must seal and clearly state the position of the signer).

The lease to a foreigner must be notarized, except for the following cases:


Individuals who rent houses for less than 6 months;

The lessor is an organization with the function of housing business.
